AFAIK, its only permitted to use the CGFX picture.datatype with a
licensed CGFX system and that picture.datatype requires CGFX. Thus
its not always possible to use the CGFX datatype. The P96 and 3.5+
datatypes do work on any system.
BTW, most subdatatypes do already support the dithering feature of
the V44 picture.datatype, eg. Stephan Rupprechts ilbmdt does.

I don't agree. The CGFX datatype created the V43 interface. This was
a GREAT achievment because the old API was very limited. However, this
datatype behaves different at times compared with the original pic.dt
and the newer V43 aware system picture.datatypes. I don't know if thats
an error in the CGFX implementation but it caused a lot of confusion :-(
Before 3.5 was released there was no official datatype.
